What's Happening?

The form revisions for June have been released by the State Court Administrative Office.  Most carry a new revision date of 3/14 or 4/14.  In most cases the prior revision of the forms can still be used until depleted as many of the changes are minor.  Here are details on the most popular forms. 

MC12, MC13, and MC52, the three writs of garnishment all had the same two minor changes.  The order of the parts was changed to make the court copy the second part.  This only changed the distribution list at the top of the form, not the body or substance of the form.  The only change in the body of the form was that the words “Plaintiff” and “Defendant” were made possessive in the name and address sections at the top so they now read “Plaintiff’s name and address…” and “Defendant’s name and address…”.  This change is so minor as to be insignificant and was only made to be consistent with most other court forms.

MC52 had one additional minor change.  The gray bar at the top was extended to the left margin to include the words "This portion to be completed by the court only" to indicate that only referred to the check boxes in the gray bar. 

Because these changes do nothing to affect the actual function of the form or the way it is filled in you can use your existing stock and we will try to sell the rest of our existing stock and ask you to help use that up to save trees and keep costs down.  The continuous version of MC12 and  MC52 we already are stocking in the new 4/14 version. 

Before we printed the MC52 continuous, we noticed the words "State Treasurer" in the distribution list at the top of the form had been changed to "Garnishee" (the same as on the MC12 and MC13).  We asked the State Court if that was intentional and they said it was not and was supposed to still read "State Treasurer".  We made that correction on the 4/14 version prior to printing it.  The State Court however made that correction but also changed the revision date to 6/14.  They allowed the 4/14 version to be used until depleted.  Our initial press run of the MC52 is dated 4/14 but has the correction.  Our next press run will have the revision date changed to 6/14 as well.   

MC09 , Dismissal, had a check box at the bottom added for the phrase, “this order resolves the last pending claim and closes the case”.

MC09a, Dismissal, Nonservice/No Progress, had a citation corrected at the bottom.  On both dismissal forms the words Plaintiff and Defendant were also changed to the possessive as was done to the garnishment forms.  We already have the new MC09 in stock in snap sets and will have it shortly in continuous format.

MC11, Subpoena, had a change made to the proof of service on the back where an extra line of fee boxes were added (adding the incorrect fee box) to make it consistent with the two line fee boxes on other proof of service sections on the backs of other forms.  The face of the form is unchanged other than the revision date.
